Sensitive Information

I understand that some personal information is particularly sensitive, and that you are trusting me to keep this information confidential. I aknowledge that information in regard to sexual health and wellness, behaviours and interests is particular sensitive .

I will only collect sensitive information by methods that are reasonably secure, such as:

·      through my intake form in Acuity when you book an appointment

·      in a zoom consultation or face to face

·      via email, please note that email may not be sufficiently secure – if the information is extremely sensitive, ask me about alternative ways to share this information with me.

The reason why I collect this information is:

·      so that I can provide you with the services you have requested from me

·      to ensure that I am providing you with the most appropriate services, this is particularly important to current medical and/or psychiatric condition, treatment and management.

The sensitive information I ask you to provide for this purpose may include:

·      your birth date

·      your medical history

·      information about your lifestyle and relationships, including sexual

I am committed to securely storing and handling your sensitive information.

·      Sensitive information is stored in a locked cabinet and on a passcode protected computer.

·      Only I have access sensitive material.

I do not routinely store sensitive information online or in the cloud. Some sensitive information may be stored securely online, or in the cloud through squarespace.

Sensitive information may be collected from children under the age of 18 under the following circumstances:

·      in the presence of their parents

·      with their parent or guardian’s full consent

All information collected from minors is securely stored in accordance with this privacy policy.

All archived sensitive information is securely destroyed after 7 years.

You may choose not to provide me with your sensitive information. However,

·      if you choose not to be completely honest with me, I may not be able to provide you with the services that you request. This is particularly important to sexual health and wellness issues. 

·      as a doctor I am legally required to identify my clients by collecting their name and address, and failure to provide this information means I cannot offer my services to you.

Disclosure of Information

Reasons why I may disclose your information include:

·      to provide you with the services you have requested

·      to send you products that you have purchased

·      referral for third party services with your written or verbal consent

In order to do this, I may share some relevant information - on a strictly need to know basis - with:

·      Australia Post or courier companies

LEGAL DISCLOSURE

I will also disclose your information if required by law to do so or in circumstances permitted by the Privacy Act – for example, where I have reasonable grounds to suspect that someone is engaging in unlawful activity, or misconduct of a serious nature, that relates to my functions or activities, and in response to a subpoena, discovery request or a court order.  I may also disclose information If I believe I am acting in your best interest for medical or psychiatric concerns.

I take reasonable physical, technical and administrative safeguards to protect your personal and sensitive information from misuse, interference, loss, and unauthorised access, modification and disclosure.

I manage risks to your information by:

·      ensuring that only I  have access to sensitive information

·      releasing information to service providers on a strictly need-to-know basis

My intention in offering these services and products is to help support your physical, emotional and energetic health and well-being.  Sexual health products are designed to help you make choices and decisions that may lead to an improved sex life.    

 

Why Work with Me?

I am a qualified medical practioner registered with AHPRA MED0001936616.  I am also a Clinical Sexologist, Masters of Medicine Sexual and Reproductive Health (Psychosexual Therapy).  

Your Responsibility

It is your responsibility for your own safety, including taking ownership over your health and health care decisions. While seeing me as a Sexologist am not acting as your doctor and we have not entered a doctor patient relationship. I will not be acting as a medical doctor, I may be part of your care team and suggest investigations and suggest treatment including medication.

On purchasing sexual health and well-being products is it your responsibility to research products to determine if they are appropriate for you.  It is your responsibility to use products as they are intended to be used.

Important Information

By working with me you can expect professional interactions. You will get the most value out of working with me by being open, respectful and having a mindset that places importance on sexual health and well-being. It is important to know that sexual health and well-being work can be very triggering and it is strongly advised that you have a professional and non-professional supportive network outside of myself for ongoing mental health support.

With any sexual wellness work or sexual healing, it is also important to be patient, gentle and kind with yourself. It may take one or multiple sessions to improve sexual health and welling.

Purchasing tickets to my Events is generated through an external website Humantix.

Risks

Any sexual and well-being work can be emotionally triggering. It is important to have a network to support you or if you have any adverse reactions post treatment to contact me or to seek medical advice. I highly recommend you consult with you General practioner or medical specialist prior to working with me.

The use of sexual pleasure toys are designed to enhance and improve sexual pleasure, however, there are always risk involved with toys during sex. It is your responsibility to use pleasure toys as they are intended to be used to reduce risk of injury or other negative outcomes. I highly recommend that you consult with your doctor prior to using my products. Products include but are not limited to; Glass toys, Butt Plugs, sex blankets, intimacy oil and intimacy rub.

The use of my products, including internally is under your own discretion. Dr Jessica Wade will not take any responsibility or liabilities for any accidents, injuries or medical bills that may occur from use or misuse.

If any concerns arise, I strongly recommend you seek advise from your regular general practioner, specialist and/or mental health care team.  It is important to get clearance from your doctor before making major changes to your lifestyle.

My services and products are primarily intended to benefit women, especially women who are ready to work on empowering and improving their sexual health and well-being.

I work with women from a variety of cultural-social backgrounds however you may not be a good fit for working with me if you have unrealistic expectations of sexual health, sexual safety and sexual well-being. You may not be a good fit if you base your sexual health and well-being on the physical body alone. You may not be a good fit to work with me if you are looking to use, misuse or seek sexual gratification through my services.

There is no service I provide that involves the selling of sex or sexual acts. By working with me you agree to a strict patient-healer relationship there is no genital contact or sexual acts performed during any of my services.

 

Limitation of Liability

If there is a problem with any Living a turned on Life product, eg minor damage, damage in transit please contact me either through website messages or email jessicawade@livingaturnedonlife.com and we can come to an agreement which includes but is not limited to, replacement, refund.  I will not replace products for change of mind. I do not accept products for return due to sexual health hygienic risks.  

I take my obligations under Australian Consumer Law seriously and will do my best to address any issues that arise. However, even if there is a major problem, my liability is strictly limited to: - replacing the goods or providing the services again; or - if I am unable to do so within a reasonable time, paying the cost of having the relevant goods or services supplied to you again.

If you feel that there is any problem with your purchase, please let me know within 7 days. I am always keen to understand what has gone wrong if you are unhappy so that I can address your concerns and try to find a mutually acceptable solution.

I do not make any guarantees or warranties about the accuracy of any material displayed on this website, with the exception of any non-excludable consumer guarantees and other consumer protection provisions set out in the Australian Consumer Law. I am human and errors creep in despite the best of intentions. If you see something that doesn’t seem right, please let me know.

Payment Terms

All payments are made through this website are processed using Stripe.

I do not have access to your account details. Any financial information you enter is stored under Stripe's security policy: https://stripe.com/docs/security/stripe.

Delivery and Shipping

I provide face to face appointment at my property in Billinudgel NSW Australia and via Zoom. If you do not show for appointment you are expected to pay full appointment fee. If cancel within 24hrs you are expected to pay 50% of fee and if you cancel over 24hours you are not expected to pay fees for intended appointment.

Shipping costs for products are calculator based on Australian post fees. This will be totalled in your purchase. I will post registered mail unless request for express post is made at time of purchase. At this stage I am only shipping to Australia. Please refer Australian Post for their delayed, lost, damaged item compensation policy.

Appointment Policies

If you are unable to attend an appointment, please let me know as soon as possible.  I understand unforeseen circumstances happen, however, in order to keep my business operational I ask for over 24hour notice for cancellation of appointment.  If you are a ‘no show’ you will be charge the full appointment fee, if cancel within 24hours of appointment you will be charged 50% of appointment fee. If over 24 hour notice given for appointment cancellation there will be no fee.  This is subject to my discretion in particular circumstances and events, eg in events outside of your control.  

Refund Policy

There are strictly no refund for change of mind about your purchase. However, I will happily meet with you to discuss your concerns and attempt to negotiate a win/win solution.

If you purchase a product that is discontinued or no longer in stock, I am happy to provide a refund or give you credit to purchase another item of equal value.

If you require a replacement product, I may request a photo for evidence of claim, eg, damaged product.  Replacement product will be sent free of charge however you may be subject to shipping fees. 

Respectful Communication

I reserve the right to delete any comments on my website or social media accounts which is rude, offensive or which I deem to be unacceptable. Keep it polite and play nicely, please.

Dispute Resolution & Jurisdiction

If you have any concerns, issues or complaint arising out of your use of this website, my products or services, or these terms and conditions, you agree to communicate with me with the intention of making a genuine effort to seek a win/win solution and trying to resolve the dispute in good faith through negotiation and discussion. Please email me at jessicajwade@livingaturnedonlife.com and expect a response within 2 business days.

If the dispute cannot be resolved by negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an independent accredited mediator, seeking mediation online or by telephone if we are not both geographically located within 100kms of each other. The mediator is to be appointed by agreement between us or, failing agreement within 21 days of the negotiation period ending, the person initiating the dispute will seek the appointment of a dispute resolution professional by the President of the Law Society of New South Wales or similar neutral authority. We agree to share all the costs of mediation equally between us. We agree that neither of us will commence legal action until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.

If a dispute arises, we all agree that we will not engage in any public discussion about the issues, we will behave politely towards each other, and we will avoid any conduct or communication which might reasonably be expected to unreasonably interfere with any other person’s business or personal interests.

This agreement is subject to the governing law of New South Wales. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, New South Wales, and the Commonwealth of Australia, will have exclusive jurisdiction.
